不可！不能強制執行！可提勞資調解！\
留職停薪由資方發動，然後再不予復職，這不就成了終止勞動契約，還不用給資遣費……\
但書：\
資方發動懲戒性的留職停薪，除非是為了迴避「懲戒解僱」，給與勞方改善的機會，因此必須有明確的懲戒時間。
