# 勞保健保相關議題

**Q: 今年2022年5月1日之後，就是不管四人以下，所有人都要強制加 “勞工保險” ?**

今年2022年5月1日生效的是 “勞工職業災害保險及保護法”!!

現有 勞工保險條例 第2條 :\
勞工保險之分類及其給付種類如下：\
一、普通事故保險：分生育、傷病、失能、老年及死亡五種給付。\
二、職業災害保險：分傷病、醫療、失能及死亡四種給付。

也就是說， 新的職災法是把 “職業災害保險” 從 “勞工保險條例” 中抽離出來，擴大適用對象。(比原本的四種，多一種失蹤給附)

但是，原來的勞工保險，還有普通事故保險這一大塊，而適用情形還是沒有變的。(五人含以上的公司才要強制加保)
