2. 個人向縣市勞工局去提調解、仲裁、訴訟

可進一步區分：是誰提供的福利？\
福利如果是「福委會」提供的福利，是由福委會決議，而非由雇主決定。

如果是公司提供的福利，一般而言都是「恩惠性給與」，基本上就是雇主決定。

但，福利事項是附屬在勞動契約，勞資雙方已有約定保證年終幾個月、三節獎金至少多少……等約定時，就屬於契約規範的部分。
